1. Order for grant of 3 % fitment benefit was issued vide letter of even number dated 15.10.2018 to such official at the time of fixation of pay on promotion to the post of Postmaster Grade-I even after availing financialu upgradation under MACP Scheme.

2. In one of the case of Shri B.V. Gavali, Postmaster Grade-I of Maharashtra Circle DOPT has referred to Para 4 of Annexure of MACP scheme which Provide that "there shall however, be no further fixation of pay at the time of Regular Promotion if it is in the same pay level as granted under MACP scheme".

3. As per prevailing Recruitment Rules of Postmaster Cadre, a Postal Assistant having Grade pay of Rs. 2400 (in pre revised) with the five years of regular service was eligible for promotion to the post of Postmaster Grade-I.
Grade pay of Postmaster Grade-l was Rs. 2800/- and on the occasion of financial upgradation under MACP scheme, a Postal Assistant was also have the Grade pay of Rs. 2800/-.

4. As the Grade pay of a Postal Assistant who availed financial upgradation under MACP scheme and Postmaster Grade I was same i.e. Rs. 2800/. Accordingly, 3% fitment benefit allowed to Postmaster Grade-I official was withdrawn vide letter No. 20-27/2015 SPN-II dated 21.11.2019.

5. Now an OA No. 1610/2019 has been filed by All India Association of Postal Supervisors before Hon'ble CAT, Chennai Bench requesting to set aside the order dated 21.11.2019. Hon'ble CAT vide its interim order dated 13.12.2019 has ordered that there Shall Be No Recovery From The Applicants


6. Therefore,
it has been decided by the Directorate that recovery arises consequent upon issuance of letter dated 21.11.2019 may not be initiated until further orders.

Annexure II: 7th CPC Bunching of Stages of Pay- Examples from the Fitment Table as per MoF. DoE OM dt. 30.8.2008 Click to View

This article is regarding the option for pay fixation on 7th CPC, after getting MACP. I came to understand that the audit has objected such switching over to revised pay structure with effect from the DNI. Let us see what the rule says.

First of all I wish to submit that MACP and promotion in the hierarchical ladder are entirely different things. The orders on MACPS clearly states that there is no change in post, responsibility and it is only a financial upgradation. For MACP, the official continues in the same post whatsoever. Also, if the official exercises option for pay fixation on his DNI, he can continue the same PB and the same GP upto his DNI, as required by these rules.

Audit has raised objections based on one ID number relates to MOD. A copy of one such objection is furnished below for ready reference. All other objections are also raised on similar grounds. 

“As per the M/o Finance, D/O Expenditure ID no 300346981 dated 14.9.2017 on the above subject, it is categorically stated that the option to switch over to the revised pay structure either on 1.1.2016 or from a later date than 1.1.2016 i.e. on the date of promotion or the date of next increment, is applicable under Rule 5 in case of post held on 1.1.2016. Thus, if the date of next increment on 1.7.2016 for a post held on 1.1.2016 falls after the date of promotion i.e. 28.1.2016, in this case, then the date of next increment for the post held on 1.1.2016 has no relevance for option, as this post is no longer held on the date of next increment. Thus, option cannot be exercised from 1.7.2016 to switch over to the revised pay structure. “
As could be seen, the above objection is about fixation after promotion, and not for MACP.
As per rule 5, 6, provisos under these rules and also explanation 1 below these rules, the following conditions are necessary for option to switch over to new pay structure on DNI or on the date of subsequent increments.
  • The official should continue in the same post from 1.1.16 to the date of switching over to the revised pay structure.
  • The official should continue in the same pay band and same grade pay from 1.1.2016 to the date of switching over to the revised pay structure. (Should retain only one pay band and only one GP). In other words, on the DNI, the regular increment as well as the increment for promotion should be on the pay band and grade pay as on 1.1.2016.
The audit objection based on the MOD communication holds good in the following cases of promotions involving change of post or change of GP/scale, and not for MACP upgradations. For example, consider the following cases.

Case 1: A postman with GP 2000 is promoted as Postal Assistant, with GP 2400 on 1.3.2016
The official joins as PA on 1.3.16 and opts for fixation for his promotion on his DNI 1.7.16 and also for switching over to revised pay structure from 1.7.2016

The official is in PB 1 and GP 2000 on 1.1.2016. On 1.3.2016, due to exercising the option, he will be paid only the difference in GP 400 in addition to his pay (pay+GP 2000+diff in GP 400). The official continues in the same PB 1 and GP 2000 till 1.7.16, his DNI. On 1.7.2016, his regular increment and the increment on promotion will be calculated only on the pay on 1.1.2016 and GP 2000. Hence the official retains only one PB and only one GP 2000. Even then, he cannot exercise option for switching over on 1.7.2016, since the official was working as Postman on 1.1.2016 and as Postal assistant from 1.3.2016. Since a change of post is involved, this official cannot exercise this option. In this type of cases only, the above audit objection is correct. As per the communication cited by the audit, the post of postman which he was holding on 1.1.2016 has no relevance on 1.7.2016. The official can exercise option for any one of the following.

(i) To switch over to revised pay on 1.1.2016, and for his promotion on 1.3.2016, can have fixation either on the date of promotion 1.3.2016 or his DNI in the revised pay 1.7.2016.

(ii) The official can continue in the pre revised pay upto 1.3.2016 and after getting his pay fixed for his promotion, he can switch over to the revised pay w.e.f. 1.3.2016, with DNI 1.1.2017. (As the promotion takes place between 1.1.2016 and 25.7.2016 he can switch over on the date of promotion).

Case 2: A postman with GP 2000 is granted MACP to GP 2400 on 1.3.2016
The official exercises option for pay fixation on DNI 1.7.16 and also to switch over to the revised pay structure on 1.7.16.
In this case, the audit objection is wrong.
The official was working as Postman on 1.1.2016 and also on 1.7.2016, in the same post.
The official was in PB I with GP Rs. 2000 on 1.1.2016. Based on his option, the official will be paid the Pay as on 1.1.2016, GP 2000 and difference of GP Rs. 400 from 1.3.2016. The pay as on 1.3.2016 should be taken as Pay in the pay band+GP 2000+diff in grade pay Rs. 400 and not pay in the pay band+GP 2400. on 1.7.2016, one annual increment and one increment for his MACP will be paid only on the pay as on 1.1.2016 and GP 2000. Hence, the official retained only one PB and one GP as prescribed in the rules. In this case, the switching over to revised pay structure on 1.7.2016 is in order, as per rules on the subject.


Case 3: A postal assistant with GP 2400 is promoted to PM Gr I with GP 2800 on 1.3.2016.
In this case, there is a change in post involved. On 1.1.2016 he was working as PA and as PM Gr I from 1.3.2016. By exercising option for pay fixation on 1.7.16, the official can retain the same PB and GP upto 1.7.16. Even then, since there is change in post is involved, the official cannot exercise option to switch over to the revised pay structure on 1.7.2016.


Case 4: A postal assistant with GP 2400 is granted MACP to GP 2800 on 1.3.2016
In this case, if the official exercises option for pay fixation on DNI 1.7.16, he can switch over to revised pay structure on 1.7.16. The official continues in the same post of PA, and in the same PB I and GP 2400 till DNI.
If the official opts for pay fixation for MACP on his date of promotion, 1.3.2016, then the official after getting his fixation should switch over to the revised pay structure w.e.f.1.3.2016 itself with DNI 1.1.2017.

Case 5: Retaining more than one pay band, GP.
One PA with GP 2400 is awarded MACP with GP 2800 on 1.3.2016. The official exercises option for pay fixation on DNI 1.7.2016 and for switching over to revised pay structure w.e.f.1.7.2016. From 1.3.2016, pay in PB I, GP 2400 and difference in GP Rs.400 will be paid.
As things stand, the same official is promoted as AAO, with GP 4800 w.e.f. 1.5.2016. The official exercises option to pay fixation on DNI 1.7.2016 and also to switch over to revised pay structure on 1.7.2016.
In this case, the official is working as PA on 1.1.2016 in PB I with GP 2400. Consequent on the MACP also, the official continues in the same post, same PB and same GP. On promotion to AAO, there is a change in post.
In this case, the following options are available.
  1. The official can switch over to revised pay structure on 1.1.2016.
  2. The official can get his promotion for MACP on the date of promotion itself on 1.3.2016 and switch over to revised pay structure on that date itself 1.3.2016.
  3. For his promotion to AAO, he can exercise option for fixation on the date of promotion 1.5.2016 or on his DNI 1.1.2017.
For the period from the date of promotion and date of fixation on DNI, the official is paid only the EXISTING GRADE PAY, EXISTING GP and the difference in grade pay.

Consider an official drawing Rs. 13950, with GP 2800 on 1.1.2016. If he is awarded MACP to the GP of 4200 on 1.3.2016, and the official exercises option for pay fixation on his DNI, then the pay of the official from 1.3.2016 would be Rs.13950+2800+1400 and NOT 13950+4200. If LPC is to be issued to this official during this period, the pay will be mentioned as PB 1 with GP 2800. The difference in grade pay will be furnished separately. This makes the difference.

As per CCS (RP) Rules, 2008, for fixation on the date of promotion, the EXISTING PAY and EXISTING GP will be taken. Also, for the period between the date of promotion and DNI, the official will be paid the existing GP and the difference in grade pay and NOT the revised higher GP.
For the above discussion, the cases of promotion between 1.1.2016 and 30.6.2016 are considered. For those officials who got their promotion after 1.7.2016 and also after 25.7.2016, the same rules hold good. The only thing is those officials who have got their promotion after 25.7.2016 cannot switch over to revised pay from their date of promotion but from their DNI after the promotion date. (Subsequent increment). Also those officials should opt for fixation for promotion on their DNI and not from the date of promotion.

I hope this matter will be taken up by our service unions at appropriate level in order to clear the position early.

This article is about the option for pay fixation consequent on the implementation of 7th CPC, especially for those who have got their MACP II in the department of posts. This is in continuation of my earlier article published on 31.12.2018.

Some of my friends state that the option to switching over to the 7th CPC from the DNI is not applicable for those officials who have got their MACP between 1.1.2016 and 25.7.2016. They cite one communication issued by Ministry of Finance, Department of Expenditure (E.III branch) in response to a query raised by Ministry of Defence through their note 1333/C/2017.

Their claim is that as per the above note, the official who was promoted on 3.6.2016 is not eligible for switching over to the new pay from 1.7.2017.

The content of the order is reproduced below for ready reference.

“2.The matter has been examined and it is informed that the option to switch over to revised pay structure either on 1.1.2016 or from a later date than 1.1.2016 i.e. on the date of promotion or the date of next increment, is applicable under Rule 5 in case of post held on 1.1.2016. Thus, if the date of next increment on 1.7.2016 for a post held on 1.1.2016 falls after the date of promotion i.e. 3.6.2016 in this case, then the date of next increment for the post held on 1.1.2016 has no relevance for option, as this post is no longer held on the date of next increment. Thus, option cannot be exercised from 1.7.2016 to switch over the revised pay structure. “

It is to be noted that “promotion” and “fixation of pay for promotion” are two different aspects involved in any promotion. As per the proviso under FR 22 (I) (a) (i), the official can exercise option for his pay fixation on promotion either on his date of promotion or on the DNI. Every promotional order must contain a clause to this effect, as per the rules on the subject.

We consider the following example for our discussion.
One official is in receipt of pay Rs. 13690 and GP 2800 (total Rs.16490) on 1.1.2016. The official is offered MACP II to GP 4200 from 1.3.2016.

Case 1. The official opts for pay fixation on the date of promotion. i.e. on 1.3.2016.
In this case the pay of the official will be fixed as follows.
Existing pay on the date of promotion: Rs. 13690+2800=16490
One increment for MACP on 1.3.16 on Rs. 16490 which is Rs.500.
Pay after promotion in the pre revised pay is Rs. 14190
Higher grade pay Rs. 4200
Pre revised pay after promotion on 1.3.2016 –Rs. 14190+4200=18390

The pay of the official is now fixed in the GP 4200 on 1.3.2016. Now this official cannot opt for switch over to revised pay on his DNI i.e. 1.7.2016, since the pay drawn by the official on 1.1.2016 i.e. GP 2800 has no relevance for option. This official must switch over to revised pay w.e.f. 1.3.2016.
His revised pay will be fixed at 47600 with DNI 1.1.2017.

The above communication speaks about this case. The official was in receipt of GP 2800 on 1.1.2016 and the same has been changed to Rs. 4200 on 1.3.2016. He can opt for switching over to revised pay only for the scale he was drawing on 1.1.2016. In this case, on 1.3.2016, as he was not continuing the same pay which he was drawing on 1.1.2016, he is not eligible for option to switch over to new scales on 1.7.2016. Also, as per note 1 of CCS(RP) Rules 2016, the official can retain only one scale and one grade pay till his DNI for switching over to revised pay. In the instant case, the GP was Rs. 2800 on 1.1.2016 and 4200 on 1.3.2016 and as such the official, after getting his pay fixed for MACP on 1.3.2016 must switch over to the revised pay with effect from the date of promotion itself.

Case 2. The official opts for pay fixation on the DNI: i.e. on 1.7.2016.
In this case the pay of the official will be fixed as follows.
Existing pay as on the date of promotion i.e 1.3.16: Rs. 13690+2800=16490
As per the option, for the period from 1.3.2016 to 30.6.2016, the pay of the official would be Rs. 13690+4200, no fixation but only the difference of grade pay.
On 1.7.2016, his pay would be brought back to Rs.13690+2800=16490.
Now the official will be given two increments on 1.7.2016, one regular increment and one for his promotion. The pay would be Rs.14700 and he will be given the higher GP Rs. 4200. The pay of the official would be Rs.14722+4200=18900.
The official can switch over to revised pay w.e.f. 1.7.2016. His revised pay would be Rs.49000 with DNI 1.1.2017, since he would complete 6 months of service on 1.1.2017.
This fixation is absolutely in order as per CCS (RP) Rules 2018, considering the following facts.
a. The official was in the pay corresponds to GP 2800 on 1.1.2016. His fixation was done on 1.7.2016 based on this GP of Rs. 2800 and not on Rs. 4200. The date of promotion 1.3.2016 will be taken for consideration for his future promotions and CCS (RP) rules deals about the pay fixation.
b. The official retains only one scale and one GP of Rs. 2800 from 1.1.2016 to 30.6.2016. Even though the official is promoted on 1.3.2016 his pay is fixed only on 1.7.2016. For his pay fixation on 1.7.16, his GP Rs. 2800 as on 1.1.2016 only has been taken. As per pay rules, the increments are regulated with reference to the pay fixation and not based on the date of promotion.
c. Since the official continues the same pay which existed on 1.1.2016, the pay has relevance for his switching over to revised pay from 1.7.2016.
d. The date of promotion is 1.3.2016 but his pay fixation is done on his DNI 1.7.2016. The difference in grade pay was given for the period from 1.3.2016 to 30.6.2016 for his promotion as an interim arrangement. It may be noted that the pay of the official is brought back to the level which he was drawing on 1.1.2016, before fixation of pay for his promotion on 1.7.2016.
e. The official cannot be said to retain two scales or two grade pays. The fact is that the official holds only one pay and one grade pay which corresponds to the GP of Rs. 2800.
f. If the official dies between 1.3.16 and 30.6.2016, his pay will be taken as corresponding to GP 2800 only and not as Rs. 4200.
In the light of the above, the option to switch over to revised pay with effect from DNI is absolutely as per rules.

Case 3: If the same official is promoted as Inspector Posts on 1.5.2016.
For his MACP II on 1.3.2016 the can opt for pay fixation on his DNI 1.7.2016 and for switching over to revised pay from 1.7.2016. He is eligible for such fixation as per the above discussion.

On his promotion to IP on 1.5.2016, he may opt to pay fixation on DNI on 1.7.2016, but the earlier option on 1.3.2016 for his MACP will become void. In this case, the official must switch over to revised pay after fixation for MACP II on 1.3.2016. The pay on promotion will be fixed in the revised pay only on 1.5.2016. This official has another option, to get his pay fixed for his IP promotion in the revised pay on his DNI in the revised pay i.e. 1.1.2017.

I hope this case will be taken by our union at appropriate level for issue of necessary instructions to all concerned so that all chaos may come to an end.

This article is regarding the option to be exercised consequent on the implementation of 7th CPC from 01.01.2016.

As per CCS (RP) Rules 2016, the following options are available.

1. An official can opt to switch over to the new pay w.e.f. 01.01.2016.

2. An official can opt to remain in the pre revised pay upto the date of next increment or subsequent increments and switch over to new pay w.e.f. the date of next or subsequent increment. i.e. 01.07.2016, or subsequent increments i.e. 01.07.2017, 01.07.2018 etc.

3. An official can opt to remain in the pre revised pay and switch over to new pay from the date of his promotion/MACPs.

There is a huge confusion in the cases cited 3 above. Especially in the case of those officials in the PA cadre and are due for MACP II in the year 2016.

It is important that the option 3 above is applicable to those officials who got their promotions between 1.1.2016 and the date of notification i.e. 25.7.2016. For those who got their promotions after 25.7.2016, they cannot exercise option to continue in the pre revised pay upto their date of promotion and then switching over to new pay. They can continue in the pre revised pay up to the subsequent increments i.e. 1.7.17, 1.7.18 etc only. This makes the difference.

For example, an official who got promotion under MACPS on 1.3.2016, the official has the following 3 options.

a. He can switch over to new pay w.e.f. 1.1.2016 and his pay on promotion on 1.3.2016 will be fixed as per CCS (RP) Rules 2016 with DNI 1.1.2017, since he completes 6 months’s period only on 1.1.2017.

b. He can continue in the pre revised pay upto 28.2.2016 and after getting his pay fixed on 1.3.2016 for his promotion as per CCS (RP) Rules 2008 (6th CPC) and then switch over to new pay w.e.f. 1.3.2016. In this case also the DNI will be on 1.1.2017. No increment on 1.7.16 as he has not completed 6 months service.

c. He can continue in the pre revised pay upto his DNI i.e.1.7.2016. The official will be governed by CCS (RP) Rules 2008 upto 1.7.16. In this case from 1.3.2016 to 30.6.2016 he will be paid the difference in grade pay for his promotion. On his DNI, he will be given two increments, one regular and another one for promotion and also the higher grade pay. Then his pay will be fixed in the revised pay w.e.f. 1.7.2016 with DNI 1.1.2017, as he has completed 6 months’ service after promotion on 1.1.2017. This option will be most beneficial to the official. 

On the other hand, consider an official, who got promotion under MACPS on 1.8.2016, the official has the following options.

a. He can switch over to new pay w.e.f. 1.1.2016, he will be given increment in the new pay on 1.7.16 and his pay on promotion on 1.8.2016 will be fixed as per CCS (RP) Rules 2016 with DNI 1.7.2017, since he completes 6 months’s period only on 1.7.2017 and not on 1.1.2017.

b. He can continue in the pre revised pay upto 30.6.2016 and after getting his regular increment on 1.7.2016, he can switch over to new pay w.e.f. 1.7.16. In this case his pay on promotion on 1.8.16 will be fixed as per CCS (RP) Rules 2016. He cannot continue the pre revised pay upto 31.7.2016 and switch over to revised pay on 1.8.2016.

c. He can continue in the pre revised pay upto 30.6.2017. In this case, he will be given the periodical increment on 1.7.2016. On his promotion on 1.8.2016 his pay on promotion will be fixed as per RP rules 2008 (6th CPC) and he will draw his next increment on 1.7.2017 after his promotion. On 1.7.2017, he can switch over to new pay with DNI 1.7.2018. The DNI is not 1.1.2018 but 1.7.2018 since the first increment for the new entrants and also the first increment after promotion will be provided after 6 months’ of service. In the instant case, the official was given the fixation on 1.8.2016 and has got his first increment on 1.7.17. Also this official switches over to the new pay only on 1.7.2017. He is not a new entrant or completed 6 months of service after promotion as on 1.1.2018.

d. He can continue in the pre revised pay upto 30.6.2017.Also the official opts for his fixation on promotion on his DNI. 1.7.17. In this case, the official will be paid the difference of grade pay from 1.8.16 to 30.6.17. On 1.7.17, the official will be given 2 increments, one regular and another one for promotion and also the higher grade pay. Then his pay will be fixed in the revised pay (7th CPC). In this case, the official will get his next increment on 1.1.2018 since he has completed 6 months service after his fixation.

The recent orders No 4-13/17-IC/E-III A dated 12.12.2018 of Ministry of Finance gives one more chance to change the option. It is very important that this chance can be utilized to change the options which are available as mentioned in (1) to (3) only and nothing more.

In my opinion, those officials who got their promotion after 25.7.2016 and before 1.1.2017 can opt to continue in the old pay up to their subsequent increment 1.7.2017 and also to exercise option for fixation on promotion with effect from their DNI after promotion i.e 1.7.17 which would be most beneficial. In this case, there will be no arrears for the period from 1.1.2016 to 30.6.2017 in the 7th CPC scales. .

A special case.

If an official gets MACPS on 1.3.2016, he can exercise option to continue in the pre revised pay upto 30.6.2016 and to switch over to new pay on 1.7.2016 after getting his fixation for MACP in the pre revised scale. If this official gets another promotion, say IPO on 1.5.2016, then the official can exercise option to continue in the pre revised pay upto 30.6.2016 and to switch over to new pay after getting his fixation benefit for his IPO promotion. In this case, the option exercised for his earlier promotion i.e. MACPS stands cancelled and the pay for MACPS will be fixed on 1.3.2016 itself as per pre revised pay and the option for switching over to new pay will be allowed only for one scale i.e. IPO scale, since the official can opt to retain only one scale of pay in the pre revised scales.

The undersigned is directed to refer to this Department’s OM No. 13/02/2017-Estt.(Pay-I) dated 27.07.2017 and its further clarification vide OM No. 13/02/2017-Estt.(Pay-1) dated 28.08.2018 Read this OM] on the issue of availability of option for fixation of pay on promotion from the date of next increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in context of CCS(RP) Rules, 2016.

2. A number of references have been received from various quarter including Secretary, Staff Side as to whether the aforesaid OMs 13/02/2017-Estt.(Pay-I) dated 27.07.2017 and 28.08.2018 will be applicable in the case of MACP also or otherwise. The matter has been examined in consultation with D/o Expenditure and it has been decided that the aforesaid OMs dated 27.07.2017 and 28.08.2018 will be applicable in the cases of pay fixation after grant of MACP also.

Sub: Implementation of Pay fixation orders in terms of the Hon’ble CAT, Principal Bench, New Delhi’s order dated 6th March, 2017.

Reference is invited to this office OM No. A-60015/1/2017/MF CGA(A)/NGE/647 dated 13th February, 2018 on the subject mentioned above vide which AAOs of CCAS consequent to implementation of 6th CPC w.e.f. 01.01.2006 were allowed minimum entry pay from the date of their promotion as AAO.

It is mentioned that some officials of other Accounts Service were posted as AAO on deputation basis in the various offices under Civil Accounts Organization during the period 01.01.2006 to 31.12.2015. The clarification on the matter whether such benefit extended to deputationist AAOs has been sought from Department of Expenditure. The matter at present is under consideration in the Department. In this regard, it is requested to provide details in respect of such Assistant Accounts Officers in the enclosed proforma.

This issues with the approval of Joint Controller General of Accounts.
