Public Notice - Processing of Partial Withdrawal requests in system latest by 31.12.2018
National Pension System Trust (NPS Trust)
Are you an NPS subscriber who has applied for partial withdrawal from PRAN but has yet to receive the funds?

If yes, please read and act upon the following message immediately:

An NPS subscriber is permitted to make partial withdrawal for specified purpose after three years of joining. If the subscriber has applied for partial withdrawal, the completed hard copy form and documents are also required to be submitted to the concerned nodal office for verification and authorization. In absence of submission of the hard copy form and documents to the nodal office, the online partial withdrawal request will remain pending in the system and the subscriber will not receive the funds.

As per advisories issued by the Pension Fund Regulatory & Development Authority (PFRDA) on 06 December 2018, in case of all partial withdrawal requests captured in the system till 30 November 2018, the required forms, information and documents need to be submitted to the respective nodal offices immediately so that verification and authorization can be completed latest by 31 December 2018. The nodal offices will be: Pay & Accounts Office (PAO) / District Treasury Office (DTO) / Drawing & Disbursing Office (DDO) for the government sector subscribers and Points of Presence (PoPs) for subscribers in other sectors. If a request for partial withdrawal is not authorized in the system by 31 December 2018, it will be treated that the subscriber is no longer interested to seek partial withdrawal and the application / request will be considered as withdrawn.

You are therefore requested to liaise with your nodal office to ensure your online partial withdrawal request, supported by hard copy application and other documents, is duly processed by them well before 31 December 2018.

NPS issue: Old Pension Scheme will be restored by AAP Govt. in National Capital

Delhi CM Arvind Kejriwal announces old pension scheme will be restored by AAP government in national capital

Delhi: Delhi Chief Minister Arvind Kejriwal announced Monday that the old pension scheme will be restored by his government and he will write to his counterparts in other states to follow the suit. He said a resolution to restore the old pension scheme in the city will be passed in a special session of the Legislative Assembly.

"It will then be sent to the Centre for approval. I will fight with the Centre to get it implemented," Kejriwal said while addressing a rally organised by the All Teachers, Employees Welfare Association (ATEWA) at Ramlila Ground here. He said that he will also speak to his counterparts in West Bengal, Kerala, Andhra Pradesh and Karnataka for implementation of the scheme.

"The government employees have the power to change the government of the country. I want to warn the Centre, if the demand of employees is not accepted in three months, there will be an apocalypse in 2019," the Aam Aadmi Party (AAP) convener said. Slogans like "desh ka neta kaisa ho, Kejriwal jaisa ho" greeted the Delhi chief minister as he made the announcement at the rally. Kejriwal slammed the new pension scheme as "betrayal and cheating" with government employees.

"I want to request Modiji that you cannot accomplish nation-building by disappointing the government employees," he said, adding that the AAP government could perform in the areas of education, health, power and water supply only because of the cooperation of its employees. The new pension scheme was introduced by the Centre in 2004. Under it, employees contribute towards pension from their monthly salary along with an equal contribution from their employer. The funds are then invested in earmarked investment schemes through pension fund managers.

CHARTER OF DEMANDS.
As finalized at the Chennai NE meeting
On 05.08.2018

1. Implement Option No. 1 as a pension fitment formula as recommended by the 7th CPC and Grant MACP benefit w.e.f 1.01.206 as per the Supreme Court judgment.

2. Revise the Pension of BSNL absorbed retirees immediately with 15% fitment, recommended by the 3rd PRC and approved by the government from 01-01-2017, delinking the wage revision in BSNL.

3. Revise pension of Central Autonomous Body pensioners.

4. (a) Provide notional fixation of pension under Option No. 3 on the basis of the pay scale/pay level of the cadre or grade from which the pensioner retired. (b) Provide fixation of pension in the case of all pre 2006 pensioners on the basis of the grade pay/pay level or pay scale of the post or cadre from which one has retired as per the judgments of Courts.

5. Extend the benefit of CS(MA) Rules to all pensioners who are not covered by CGHS.

6. Increase the FMA to Rs. 2000 as has been granted to PF Pensioners and introduce the health insurance scheme as suggested by the 7thCPC.

7. Raise the minimum pension to 60% of the Minimum wage. i.e. Rs. 10,800 p.m.

8. Restore the commutation portion of pension after 10 years.

9. Provide increased rates of pension on attainment of 70 years onwards.

10. Scrap the New Contributory pension scheme and restore the defined benefit pension to all CGEs irrespective of their date of entry into the Government service.

Subject: All India Protest Day for 26th November, 2018 - Instructions under CCS (Conduct Rules), 1964 - Regarding

It has been brought to the notice of the Government that National Movement for Old Pension Scheme (NMOPS) has decided to observe 'Gherao of Parliament House' on 26th November, 2018 in order to demand withdrawal of New Pension Scheme (NPS).

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department's O.M. No.33012/1 /(s)/2008- Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed protestlGherao, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on protest/Gherao, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty in the day of protest/Gherao, i.e., 26.11.2018.

Subject – Proposed nationwide protest by Government employees against New Pension Scheme on 26th November, 2018.

The undersigned is directed to enclose herewith a copy of DoPT’s O.M. No.33011/2(s)/2018-Estt. (B.II) dt 26.10.2018 on the subject mentioned above. Attention is also drawn to the instructions issued by the D/o Personnel & Training vide OM No.33012/1(s)(2008-Estt(B)(pt) dt. 12.09.2008(copy enclosed).

2. The instructions issued by the Department of Personnel & Trainng prohibit Government servants from participating in any form of strike including mass casual leave, go-slow, sit down etc. or any action that abet any form of strike which is in violation of the provisions of the CCS (Conduct) Rules. 1964. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also upheld in several judgments that going on strike is a grave misconduct under the Conduct Rules and that misconduct by me government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which, besides deduction of wages may also include appropriate disciplinary action.

3. All the officers are requested that employees under their control be advised to scrupulously follow the provisions of the CCS (Conduct) Rules, 1964 and the findings of Apex Court on the subject. No Casual leave or other kind of leave to employees is to be sanctioned, if applied for, during the period of the proposed dharna/strike.
